General Terms
Data Privacy
Mainstream Public Cloud Services is committed to protecting the privacy of all its users. We collect only the necessary, basic user data required for business operations and for informing users, in accordance with good business practices and for the purpose of providing quality service. For the purpose of domain registration on behalf of its Users, Mainstream Public Cloud Services will forward the collected data to the Serbian National Internet Domain Registry (RNIDS) and the Internet Corporation for Assigned Names and Numbers (ICANN), in accordance with the rules governing national and international domain registration.
All user data is strictly protected and accessible only to employees who require such data to perform their duties. All employees of Mainstream Public Cloud Services are responsible for adhering to data privacy protection principles.
In order for Mainstream Public Cloud Services to successfully process a User’s request for service activation, the User must provide accurate information:
- If the User is a natural person: full name, residence address, phone number, email address, personal ID number (JMBG) or passport number for foreign individuals
- If the User is a legal entity or entrepreneur: company name, registered office, registration number, tax ID (PIB), phone number, email address, and the full name of the contact person (or equivalent data for foreign legal entities)
If payment for Mainstream Public Cloud Services is made via payment card, entering the card number is secure, as the transaction is automatically redirected to a secure server for further processing.
Limitation of Provider Liability
- The Provider shall not be liable for congestion, delays, or errors in parts of the Internet beyond its control.
- The Provider shall not be liable for any damage caused by the User to third parties through unauthorized behavior.
- The Provider shall not be liable for violations of user privacy or security carried out by third parties on the Internet. The Provider is also not responsible for the security or accuracy of information exchanged between users.
- The Provider shall not be liable for damages incurred by the User or third parties due to the User’s failure to keep their account credentials confidential.
- The Provider does not guarantee that files downloaded from the Internet are free from viruses or other malicious or destructive programs.
- The User is responsible for implementing appropriate procedures and checks to protect against such programs. The Provider is not liable for any resulting damage.
Prohibited User Behavior
User behavior shall be considered prohibited if it is contrary to mandatory legal regulations of the Republic of Serbia, international law, or agreements, conventions, recommendations, and codes accepted by the Provider, of which the User has been informed.
In particular, prohibited behavior includes:
- Committing criminal offenses or economic violations
- Violating copyright or industrial property rights

- Engaging in unfair competition
- Endangering or violating personal rights of others
- Violating good business practices and consumer protection rules
- Violating contracts, conventions, and recommendations in the field of telecommunications law, as well as Internet Codes of Conduct accepted by the Provider and communicated to the User
Examples of prohibited behavior include:
- Distribution of unsolicited emails via email or Usenet
- Unauthorized access to or control of other Internet systems
- Spamming Provider servers by sending identical unsolicited messages to multiple addresses
- Disrupting normal service use by other users or interfering with network operations (including SBB or any other network)
- Sending or forwarding charity requests, petitions, chain letters, or promotional/advertising materials outside designated channels
- Distribution of viruses or other malicious or destructive software
Provider Rights in Case of Prohibited Behavior
If the Provider determines that the User is engaging in prohibited behavior, it has the right to issue a written warning and request cessation of such activities, and to suspend the Agreement for up to 10 days. In such cases, the Provider may also share relevant user data and information about the misconduct with interested parties.
If the User continues prohibited behavior after a warning, the Provider has the right to terminate the Agreement with notice. In this case, the User forfeits any unused portion of paid fees and is liable for all damages caused.
The Provider’s assessment of prohibited behavior shall be considered valid when there is reasonable suspicion of such behavior as defined in these General Terms.
The Provider reserves the right to suspend or terminate services without prior notice and without refund if it is determined that the service is being used in violation of these General Terms and/or applicable rules and agreements governing Mainstream Public Cloud Services hosting.
Provider’s Rights in Case of Prohibited User Behavior
The Provider shall not be liable for interruptions in server connection to the Internet if such interruptions are caused by maintenance or infrastructure work, provided that the User is notified at least 3 days in advance and the interruption does not exceed 24 consecutive hours.
User Responsibility
The User bears full criminal, civil, and any other liability for their prohibited behavior. The User is liable to the Provider for any damage caused by such behavior.
Communication Between Provider and User
All communication between the Provider and the User regarding matters relevant to the Agreement shall be conducted in written form, including email or notices published on the Provider’s website.
An email shall be considered delivered on the day it is received in the User’s mailbox hosted by the Provider. A mailbox refers to the storage space on the Provider’s servers designated for receiving emails, from which the User can download messages at any time.
Changes to General Terms
The Provider reserves the right to modify any or all provisions of these General Terms without prior notice and is obliged to inform the User promptly.
Changes become binding once accepted by the User. Acceptance is deemed to occur upon payment for services after the User has been notified of the changes.
Jurisdiction Clause
Any disputes arising from the Agreement shall be resolved amicably. If this is not possible, the competent court shall be the court in Belgrade, applying the substantive and procedural law of that jurisdiction.
